Wisconsin Durable Power Of Attorney

Posted on June 3, 2010.
Wisconsin Durable Power Of AttorneyCan you file a civil suit against a lawyer and officer of POA?

A POA for a client was a demand for rapid two areas, one the director was aware, but not the other. The principal was never informed of the second application fast and the officer had referred to the lawyer, but he did not file his name Inder for 3 years. The principal does not remember signing the second application quickly and said would never have. The notery said that until someone can verify the signature it noterize. I live in Wisconsin and the laws are there but does not seem to be strengthened., For example, the right Wi said that if the POA is durable, it must have two witnesses and the officer must sign, but after that I have encountered, they don 't apply it and its still considered legal. I am now the new POA and with things like how do I get property managers return, I contacted a lawyer, but even after the previous POA won his savings, he responded, I am told that she had the power to do it even if it has no power to give gifts. Can anyone help?

Unfortunately, remedied the situation like this can make more money than anyone involved can afford. Guardianships are often abued lasting (in England, "sustainable") of proxies may be an invitation to abuse and theft. This is what the lawyers deal with seniors, and you can talk to one. The Washington Post article link below is instructive.

Get your good conditions. Talk about a quitclaim "deed, which transfers all the rights that the person has, often as a gift. It is not binding as to third parties unless recorded.

Regarding a public officer if what you say is true, the lawyer has violated the law. But, as with all your other allegations, he must be proved beyond a reasonable doubt.

If someone gave or received goods without authorization, it may in principle be recovered on a theory of trust contruction, for lack of consideration, or as a fraudulent conveyance. These are issues you should discuss with a specialist in elder law.

Good luck.
