I need to evict one of my tempting and I need help completing this form. They are tenant at will. I need the apartment for my son and his wife. I do not understand certain terms. Can anyone help me? I want to go out by August 1st and I decided to give them the notice on July 1st. Here's the review: 30 Days Notice to Quit
Notice is given to the above parties under the provisions of Chapter 186, Section 12 of Massachusetts General Laws and their dependents to engage you and leave you currently have a tenant of __________ (owner) to the above address known and numbered as ____________, _________ suite with rooms and outbuildings belonging to it, 30 days after the next rental period beginning on ________ mind after receiving this notice. A default setting aside of the legal action may be brought to evict you.
You are further notified in any case that your lease is terminated:
__________Any Money deposited by the tenant and accepted by the owner or his agent after the receipt of this notice will be accepted for use and occupation, and not as rent and without in any way waive its rights under this notice leave and notice of termination. The landlord reserves the right to accept such monies without establishing any new tenancy. You in no way be responsible for the use and occupancy charges for the time you occupy the premises.
You are advised to call at trial of any action of summary treatment of any extension thereof, the original of this notice and any other written evidence on this issue.

Blank # 1: Your Name

Blank # 4: number of days that you give them leave after receiving the notice
Blank # 5: The date given the number of days that you give them to leave after receiving the notice

You do not need to evict your tenant. Eviction is the forced displacement of a tenant who has not paid rent or has broken the rules of the lease. In this paper a trial and all - is the wrong document!

Instead, you want to issue a notice to vacate. First, do it in person. Give them more than 30 days so they have time to find a new place. Do not be a jerk about it. Tell them in person that the apartment is no longer available for rent after August 1, and you are very angry. Then tell them you have the official documents in the mail soon.

Whatever you do, do not serve with the above document. You have no reason to expel them, which can cause you serious trouble.
