Probate Limits

Posted on July 11, 2010.
Probate LimitsIs there a deadline for approval of a judge to settle an estate?

I have received from counsel the final settlement of the estate of my aunt two months ago, Have not received my share of estate.Do I need to be patient?

I would suggest you contact the lawyer handling the estate.

Yes, you must be patient. The lawyer must file a tax return on behalf of the deceased with the Internal Revenue in the U.S. or Canada CRA. Once they have processed the tax return, it will issue a certificate which allows your attorney to actively distribute the estate to the beneficiaries. From my experience (with the Canada Revenue Agency), the time the tax return is sitting in their offices, while being "treated" is eight months! Patience is a virtue right here! Good luck!

PS This has nothing to do with the probate judge. It is the work of the lawyer, the judge just rubber stamps it.

you need to be patient, my wife waited 3 1 / 2 years and still has no money
