I ruined my trade mark application. How do I deposit / cancel so I could file a new one? Is it possible to just cancel the request (I know that charges are non-refundable) and file a new application instead? The issue has come to choose the misclassification of the mark, and counsel for the USPTO has highlighted a conflict with an already existing brand. It is an American brand. Thank you in advance.
You can review the classification by means of an amendment without having to reapply.
See METR 1401.03 (b): "After consideration, the classification must be changed if the number of classes are not correct. When the prosecutor in question requires or recommends an amendment to the identification of goods or services that involve change the classification, examination prosecutor should also require that the classification is changed. "
