Mutual Release FormWe signed a mutual release form when the house where we tried to purchase does not pass the inspection.?

The sellers have not signed the statement back and their broker does not meet our 5000.00 dollar deposits, it seeme that vendors play dirty. What should we do?

From what I understand (I am a salesman trying to sell my house), after examining attorney, if the buyer withdraws the seller may keep the deposit. Talk to your real estate lawyer about this. He / she know all the details and what avenues you need to recover your deposit.

Answering the first, the seller should not prevent the deposit!
the house does not pass the inspection! This means that the house is not safe!

Contact real estate and if it does not work, cops

What is your contract? Your policy must have an inspection period of 7-10 days. If you have an inspection period you would be able to terminate the contract within this period by providing the list / seller broker with written cancellation. If you're in the timing of your inspection period, contact with the local real estate for arbitration.

If you have not had an inspection period, you may have to prove that the broker or dealer registration and / or owner are at fault somehow.

Without actually seeing the contract, I can not give you an answer set, but I hope you help. If you have an agent, they should be able to help you interpret the contract. Otherwise, write me and I can read it and give you my professional opinion.

I was in a scenario similar to that of an agent of the buyer. I contacted the broker agent to increase the pressure. And, finally, after the movement does not cause my hand, I had contact their broker MY.

Basically, they are dragging their feet. They really have no reason to keep your earnest money, so it will eventually be returned to you (unfortunately if you had that money in an interest bearing account, you do not earn interest for that time).
