It is a question of administrative law and you can either sue someone in civil court or you can go after them under the provisions of your provincial law of labor relations (labor law or what ever ... it is called in your province).

For example, in Alberta, you would under the provisions of the Labour Relations Board of Alberta ( http://alrb.gov.ab.ca/ ) Visit their site under the heading "Guide of the code" and you say which provisions are applicable ... at least in this province.

It would be a civil trial, and in Canada, if you sue someone, and you lose, you pay the legal fees of the other person, as well as its own costs. Be very sure of your facts before you begin any legal action.

The provincial Department of Labour can give you advice on your rights. They will not act on your behalf in court. It's your choice.
